Client approaches a Registered Debt Counsellor who will do an assessment to make a determination if the client is either Over indebted, experiencing financial difficulties or not over indebted. If the Debt Counsellor determines that the client is over indebted, the Debt Counsellor will contact all your creditors, who will send him your latest account balance information.
The Debt Counsellor uses that information to create a payment plan or proposals to help sort out your debt problems. The payment term will be extended as reduced payments will be made to creditors. The Debt Counsellor will than refer the matter to the magistrate to make a formal order for the payment plan. The client will have protection from creditors harassment, the National Credit Act is there to protect the client. Once you are on Debt Counselling no more credit access will be given by creditors till Debt Counselling is finalized.
The Debt Counsellor will make an informal arrangement with your creditors to pay your debts. This process will be used when the client experiencing financial difficulties but not over indebted.
With the Informal Mediations client will have access to credit while the Mediation is in place.
BMH Debt Solutions will review the Garnishee Order to determine if it was granted properly or reduce the amount payable monthly and have more money available for living expenses.
